Respondents had successfully sued the appellant for a declaration of title to a piece of land in Ogbomosho. It was held that though the survey plan pleaded and tendered by the respondents was unreliable, a plan is not an absolute necessity in every land case.

Appellant's appeal to the Court of Appeal failed and he further appealed to the Supreme Court.
